1. ACCEPTANCE OF TERMS

These Terms and Conditions govern access to and use of the iberbrain application. By registering and using this application, the user confirms that they have read, understood, and fully accept these Terms and Conditions. If you do not agree with any of the provisions herein, you should not use the application. These Terms and Conditions constitute a legal agreement between the user and Susana Coutinho, author, owner and developer of the iberbrain app, responsible for its creation, maintenance and management.

2. PURPOSE OF THE IBERBRAIN APPLICATION

The iberbrain application is a technological platform designed to support and implement activities related to:

• exercises based on the RGM method,

• creative therapy exercises,

• cognitive stimulation and well-being activities,

• educational, institutional, professional or personal programs,

• team building activities and workshops.

The app can be used in personal, educational, therapeutic, institutional or professional contexts, depending on the programs offered and any services contracted. The user agrees not to use the iberbrain application for illegal, abusive, fraudulent purposes or that violate third party rights.

2.1. Institutional, Professional and Commercial Use

The iberbrain application may be used in institutional, educational, therapeutic, clinical, corporate or professional contexts, provided that such use occurs within programs, activities or services developed, authorized or contracted directly by the app owner. Use of the app by institutions, organizations, companies, schools, care homes, day centers, clinics or other entities may be subject to specific terms, additional agreements, usage licenses or separate contracts, defined on a case-by-case basis. Institutional use of the app does not grant any right to reproduce, redistribute, sublicense, adapt or independently exploit the platform, its content or methodologies.

3. ACCESS AND USE OF THE IBERBRAIN WEB APPLICATION

3.1. Web Application Access

iberbrain is a web application accessible through compatible internet browsers such as Google Chrome, Mozilla Firefox, Safari, etc. Internet access and a compatible device (computer, tablet, smartphone) are required to use the app.

3.2. Technical Requirements

To use the application correctly, the user must have: • an updated internet browser; • a stable internet connection; • a compatible device with web access; • a valid email address.

3.3. Responsibility for Access and Use

The user is responsible for ensuring that their device and internet connection are suitable for accessing the app. The owner of iberbrain is not responsible for access failures due to technical issues with the device, network or incorrect configuration by the user.

3.4. Availability and Maintenance

The iberbrain application may be temporarily interrupted for maintenance, updates, or improvements. While efforts are made to ensure continuity, uninterrupted availability is not guaranteed.

3.5. Limited Access and Ownership

Access to the application is personal, limited, and non-transferable, and is granted only to the registered user who accepts these Terms and Conditions. The iberbrain application, including its source code, design, structure, proprietary content, functionalities, and brand, is the exclusive property of Susana Coutinho and is protected by copyright and intellectual property laws.

3.6. Limitation of Liability

iberbrain is not liable for direct or indirect damages, data loss or interruptions in access due to technical failures, connection issues or external factors beyond its reasonable control.

4. REGISTRATION IN THE IBERBRAIN APP

To use the iberbrain application, the user must register by providing a valid email address and other required information. Registration may be subject to validation. After confirmation, the user will receive instructions for access. Access to and use of the application assumes acceptance of these Terms and Conditions and the Privacy Policy.

4.1. User Responsibility

The user agrees to provide truthful, complete and up-to-date information. Misuse of the account, false information or violation of these terms may lead to suspension or termination of the account. The user is responsible for keeping their login credentials confidential and for all activities under their account.

4.2. Consent to Use of Personal Data

Personal data is processed in accordance with the iberbrain Privacy Policy and the General Data Protection Regulation (GDPR).

5. INTELLECTUAL PROPERTY

All intellectual property rights related to the iberbrain app, including software, design, texts, functionalities, structure and proprietary content, belong exclusively to Susana Coutinho, unless otherwise stated. Use of the application does not grant the user any ownership rights over the content provided.

6. THIRD-PARTY INTELLECTUAL PROPERTY RIGHTS

The iberbrain app contains content and methods from third parties that are legally used in accordance with the respective copyrights, licenses and professional practices. Certain content, including musical works, is used under appropriate licenses, namely Creative Commons, with correct attribution visible in the content or player. Regarding the RGM (Ronnie Gardiner Method), its use in the application is carried out under the professional certification of the iberbrain creator, fully complying with the principles, references and rights associated with the method, including copyright notices where applicable. Use of the application does not grant the user any rights over third-party copyrighted content. The user agrees to fully respect these rights. 7. CHANGES TO THE APPLICATION AND TERMS

The owner of iberbrain App reserves the right to modify, update or suspend, wholly or partially, the app and these Terms and Conditions at any time. Changes will be published in the app or communicated to the user.

7.1. Additional Services, Programs and Contractual Conditions

iberbrain may offer specific programs, personalized content, training, workshops, institutional licenses, differentiated access or other additional services.. Such services may be subject to specific terms, additional provisions, written contracts or separate commercial agreements, which will take precedence over these Terms and Conditions in case of conflict. Purchasing additional services implies express acceptance of the respective specific conditions.

8. LIMITATION OF LIABILITY

The iberbrain application is provided “as is,” without express or implied warranties. Use of the app is the sole responsibility of the user.

9. SUSPENSION AND TERMINATION

User accounts may be suspended or terminated in case of violation of these terms, misuse of the app or failure to comply with applicable law.

10. MINORS AND USERS WITH SPECIAL NEEDS

Although the application has no age restrictions, it is recommended that minors use the app with the consent and supervision of a responsible adult. In cases of cognitive or motor limitations, supervised use is recommended.

11. CHANGES TO TERMS

These Terms and Conditions may be amended at any time. Continued use of the app after publication of changes implies acceptance of them.

12. GOVERNING LAW

These Terms and Conditions are governed by the laws of the Netherlands, and the courts of this jurisdiction have competence for disputes.
